The customer agrees to the following terms and conditions. By placing an order the client is authorizing the company to pass on the order to the respective merchant / vendor and make sure the product is delivered to the given address. While rendering the service the company is acting only as an authorized representative of the client and not as his agent or in any other capacity. The company shall be handling the material only as a service provider and its liability shall be restricted to that of a bailee under the contract Act. Nothing contained herein shall create or be deemed to create or construe a relationship between the parties such that Shoppinggarnet.com is regarded as a seller or purchaser of the Vendor / Merchant's products and all sales and purchases of the Vendor / Merchant's products pursuant to an order placed on the Shoppinggarnet.com Internet Properties are transactions between the user placing an order for the same on the Shoppinggarnet.com Internet Properties and the Vendor / Merchant. Shoppinggarnet.com is an online store for the vendor / merchants to host and sell his merchandise and a facilitator of the sales contemplated herein.

Definitions :

Shoppinggarnet.com : The company providing the online store and delivery service.
Customer : The person using the online store and delivery service.
Products / Goods : Products ordered by the customer.
Products : The products delivered to the recipient will be generally as per the description of the article and as per the picture chosen by the customer.

There may be variations in appearance and colors. The non-perishable articles like leather goods, hand made ceramics and silver articles may also have variations as these goods are hand made. The customer agrees to the variations and understands the nature of the variations and allows Shoppinggarnet.com to deliver a product which is similar to the product picture exhibited on the web-site.

Payments : Charges displayed on the site are inclusive of cost of the product, delivery charges, service fee for charging credit cards and facilitation fee (Details of break up will be provided on request). In case the customer would like to pay using an alternate payment mode that is acceptable to us the service fee for charging credit cards will be deducted from the total amount payable. If the product is picked up directly by the customer from the vendor the applicable delivery charge will be deducted from the total amount payable by the customer. We accept all International and Indian Credit Cards and also offer payment option through Net-Banking. Customers using foreign and international cards should note that this online payment gateway accepts payments only in Indian Rupees. Therefore, the amount charged is the INR value of the product displayed on the site which is converted into US Dollars or any other foreign currency at the actual prevailing conversion rate while passing on the order to the payment gateway.

This may differ from the dollar price shown on the site which has been calculated for the purpose of indication only at the conversion rate of INR 44.00 to a US dollar.

Accuracy of information and intent of making payment : The customer promises that the information provided to Shoppinggarnet.com will be true, current, correct and accurate including credit card numbers and addresses. The customer also agrees to pay all charges incurred by them and users of your account and credit cards or other payment mechanism at the charges in effect when such charges are incurred.

Brands, Trade marks and logos : Shoppinggarnet.com is an online store for the vendor / merchants to host and sell his merchandise and a facilitator of the sales.

We do not claim any right or representation of any of the brands. All brands belong to the respective owners. Shoppinggarnet.com does not have any exclusive selling or distribution rights. All brands are displayed in the catalogue to add variety to the content and allow the customer a wider choice in selection of products. Each manufacturer holds the sole responsibility for the quality and performance of its respective branded products.

The customer agrees to defend, indemnify and hold Shoppinggarnet.com and its affiliates harmless from any and all liabilities, costs and expenses, including attorneys' fees, related to any violation of this Agreement by them or your authorized users of your account.

The customer also agrees to defend, indemnify and hold Shoppinggarnet.com and its affiliates harmless from any and all liabilities, costs and expenses, including attorneys' fees, in connection with the use of the Service or the placement or transmission of any message or information or other materials by you or authorized users of your account.

Shoppinggarnet.com may modify this Agreement from time to time by changing the above terms and condition. The terms and conditions applicable to the customer will be the ones that were prevailing on the day and time you placed your orders.

Delivery

Non Availability : If the ordered product is out of stock and Shoppinggarnet.com is unable to deliver the product, a complete refund will be made to the customer. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc caused due to the non delivery and non availability.

Delivery Attempt : Is when Shoppinggarnet.com tries to deliver the product, and is unable to do so due to either:

• A wrong address or
• No one being at home.

Late Delivery : If the delivery is made after 15 days of the "preferred date" a 25% discount will be refunded to the customer. This is provided no delivery attempt was made by Shoppinggarnet.com and if the delay has not been communicated to the customer.

In case a delivery attempt was made and could not be delivered due to either a wrong address or no one at home, no refund will be given.

Non-perishable goods : The product will be returned to the Shoppinggarnet.com office in Jaipur. In the event of no one being at home, every genuine effort shall be made to a re-delivery. In the unlikely event the product is unable to be delivered due to no one being at home we will return the goods to the Shoppinggarnet.com office in Jaipur. The customer will be informed. The goods will be held for 15 days at the office. No refunds will be given to the customer. The only exception will be if the value of the product exceeds Rs.2000, a cancellation charge of 25% will apply and the balance returned to the customer.

Delivery Period and Timing : Shoppinggarnet.com shall try to deliver the product on the 'preferred date'. Please allow the minimum time required for delivery as specified in each category. Product deliveries shall be made within three to seven working days in India provided the time specified for that category of products is not more. Delivery shall be made on the 'preferred day', or a day earlier or later if it coincides with a festival day or a national holiday. Delivery shall be made in the course of the day, and the customer agrees to refrain from requesting for deliveries at very early or late hours of the day. All attempts will be made to deliver at the specified time on the preferred date of delivery but Shoppinggarnet.com will not be held liable if the delivery does not take place on the specified time. Delivery during festival times will be made during the period as specified on the Shoppinggarnet and not necessarily on the preferred date as given by the customer.

We DO NOT deliver on SUNDAYS and Public Holidays in India

Cancellations

Once a product is ordered it cannot be cancelled by the customer. The reason being that the system immediately processes the order and sends shipping instructions to India. Due to the high volume of transactions and because the instructions are sent to over 200 towns it becomes difficult to cancel the orders. In case we receive a cancellation notice and the order has not be processed by us, we shall cancel the order subject to a 10% cancellation charge. Shoppinggarnet.com has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by Shoppinggarnet.com and accept Shoppinggarnet.com decision regarding the cancellation.

On cancellation of an order after it has been processed by Shoppinggarnet.com and not yet delivered, the cancellation charges will be as follows: Cancellation charge - 50%, refund to customer 50%.

Once a delivery attempt is made, no cancellation will be accepted and no refunds will be made.

Warranty :

Perishable Products : Shoppinggarnet.com does not provide any warranties on the products it delivers.

Non-perishable Products : Warranties are provided by the suppliers of the products in certain items such as electrical and electronic goods. The customer agrees that the customer service issues regarding the products will be taken up with the manufacturer directly. Shoppinggarnet.com will pass on any warranty cards if available to the recipient of the product at the time of delivery.

Disputes : All and any disputes related to "Shoppinggarnet.com" service shall be subject to the jurisdiction of Jaipur (India) courts.

Fraudulent / Declined Charges : Shoppinggarnet.com reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the site fraudulently. Shoppinggarnet.com reserves the right to sue the recipient in case of fraudulent charges and denial of charges by the customer.
